Brownstone AC condenser location

Hi all, I wanted to see if anyone has run into the issue of where to place a ductless minisplit condenser for a landmarked Boerum Hill brownstone. Previously there had been a regulation requiring condensers to be 8ft from any property line, therefore making the roof the only location to realistically place a condenser. It looks like in 2012, though, according to the Zone Green Text Amendment http://www.nyc.gov/html/dcp/html/greenbuildings/index.shtml (see bottom of page 5-6, bottom of page 8) there was an adjustment to the building code to promote more efficient technology. The stated goal of this initiative (according to the nyc.gov website) was to “to remove zoning impediments to the construction and retrofitting of green buildings”. I’m reading this as it is applicable to both existing buildings AND to new construction. Also, I cannot find any footnote or exclusion in the amendment text saying that certain buildings do not apply, and the text specifically states “in all residence districts the following obstructions shall be permitted in a required yard”. According to the amendment, the text stating that condensers needed to be 8ft from the property line was omitted (some caveats if there is a street view). Now to get to my question. I would like to have the condenser (just a single 3-zone condenser, Mitsubishi or similar) placed in the rear corner of our yard – there is a nice space for it to be hidden behind a tree while still having enough clearance on 4 sides and above, and length of the line run isn’t an issue. This would avoid the extensive costs of structural design for steel dunnage, construction of steel dunnage between parapet walls, getting the steel and condensers to the roof, and if we want the most aesthetically pleasing solution, running the lines through the entire house to the basement/cellar apartment. There has been a suggestion by my architect that this is a code violation – first the 8ft rule which was disproved by the above code amendment from 2012, now that buildings existing prior to 1966 are excluded. I would argue that based on the same text, “in all residence districts” and the absence of any exclusionary terminology this is also not true. Has anyone actually placed a condenser in the rear yard of their brownstone? Have you had similar ‘code issues’? Thanks in advance
