1 to 2 family conversion

For you code experts out there, I have a 2 story and basement class III (non-fireproof) single family, in an R6\. I need to convert it to a 2 family, so that the basement is a single dwelling unit and the 1st and 2nd is the other. I am not certain if and whey sprinklers would be required, since I plan to file under 1968 code and table 4-1 does not imply I do. It was built prior to this date. Any thoughts?

Correct. If the street is wider than 38′, then a fire truck has easy access and sprinklers are not required. Unless you’re on an avenue, this is very rare.

Thank you for your quick reply. If im reading the FC correctly, the sprinklers are required only if my street width is less than 38feet. If the width is larger, then I do not see where sprinklers are required. Please confirm. Thanks

FDNY Code: An existing building on a public street of substandard width (less than 38′ curb to curb) that undergoes alteration or a change in use or occupancy is required to install a sprinkler system throughout such building, when: 1-4 do not apply here 5. A one-family dwelling is being altered to a two-family dwelling, except where: a. the alteration involves converting a basement or cellar space to a separate dwelling unit, and the new basement or cellar dwelling unit is protected throughout by a sprinkler system; or b. the alteration does not involve converting a basement or cellar space to a separate dwelling unit and at least two lawful accessory off-street parking spaces are provided on the premises. According to this, yes, you do need to add sprinklers when converting from one- to two-families, unless the basement unit is already sprinklered.
