HPD Violation and Refinancing

I agree with bricktop. Worst case the bank might want to escrow $1,000 or so until HPD records are updated but with proper documentation it shouldn’t even come to that.

Dear Brownstoners, Does anyone know if it is possible to refinance with a HPD violation for non-registration?  I am in the middle of a refinance and just found out I have a HPD violation for not registering my 3 Family Home.  I actually submitted the form but my husband and I both signed the form as owners which is not allowed (only 1 person is suppose to sign) and it got rejected–and not submitted.  Long story short –we weren’t notified and the voilation is outstanding. We went down to the Manhattan office of HPD and filled out the registration form.  According to the ladies who work there I am now registered and need to go to my local Brooklyn HPD to have the violation removed.  Apparently the assistance employee was wrong and unfortunately the registration hasn’t uploaded in the system and according to another person at HPD will take like 8 weeks to process.  You have to register before you can request a removal of a violation.  Now I am in danger of losing my refinance and locked rate.   Does anyone have any advice? I sould say talk to your bank. This sounds to me like the equivalent of old, small issues on a credit report. For those you can often write a letter to the lender explaining them and, if small enough issues, they will not consider them an obstacle to your financing. This is SUCH a small issue, and as long as you have the documentation to back the story up, I would ask the lender if you could do the same thing here.
