Extending Parapet?

Hello Brownstoners, my neighbor has an old extension that is partially on my property. The extension is old, older than 10 years and is now legal but can she legally extend the parapet on the exterior wall that is on my property? There are no permits in the window but I don’t want to get the city involved if she has rights to the space above her extension on my property. Thanks for any help!

10 years does not make it legal.  We have done this in the past, but it is a legal agreement between both owners put on the deed.
