Separting Apartments in 2-Family Brownstone
The most elegant way I have seen this done and also cost effective is not to do the wall which looks ugly generally, and requires a lot of work. Instead making cast iron door and triangular rail around the stair which could be easily removed in the future without damaging the property or taking away from it’s beauty. I have a 2-family brownstone in the ‘typical’ (I think) layout for the neighborhood – bottom duplex apartment with another apartment on the 3rd floor. What is the legal way to separate those apartments so that the top floor apartment can have a separate entrance with a locked door?

To build a separation you need to file plans and get them approved, depending on the width of the hallway, the door ways etc. will determine where it can be built, due to access requirements most cannot legally be done. It is easier if the tenant takes the garden floor and enters under the stoop and the owner lives in the upper duplex and enters up the stoop, with a deck off the back to the garden. And the door at the top of the stairs or the bottom of the stairs between the parlor and garden floor is locked.
