Recently bought house w/ kitchen not in place of 1950's DoB plans.
The drawing of our house on file with the DOB is obviously a drawing done as a generic row house, because – outside of main dimensions – the facade doesn’t even match. For example, the plan shows 3 windows across the back wall in the parlor – there are only 2 windows on the parlor floor. The upper floors do have 3 windows across, but the parlor floor was never modified. It was just drawn wrong. 1n 1905, a date many people erroneously believe is the construction date, all of the houses in my area of Brooklyn had to be filed with the city. Many buildings were not drawn exactly, as much as registered by using a generic, somewhat accurate drawing. It’s possible if your house was filed using a generic plan, and the kitchen was simply drawn in the wrong area.

There is an illegal kitchen in the two-family house we just bought. As per the existing DoB plans (icards) from the 1950s, the kitchen exists but on on another floor. [So, to clarify, there are no excess kitchens – it is a 2 family and there are 2 kitchens in the house). However we want to keep the illegal kitchen exactly where it is. Will this be a problem? How much would it cost to rectify with the DoB (the violation)? Thanks

Is there a current violation? If not, and you aren’t planning to do any work, just leave it. If you are planning to renovate anyway, your architect will present it as new construction (assuming it meets code, etc).

Some straight arrow architects may chime in to say you should fix it, but I’m with Putnamdenizen. Let sleeping dogs lie. In your post …”How much would it cost to rectify with the DoB (the violation)?” – do you mean there is a violation on file that you find on the DoB’s BIS system? or just that the location doesn’t match the CofO? If it’s the latter I don’t see why it would be a problem.
