I read and appreciate your post above, Concord, but had lots of other questions for the attorney so a consultation was in order. The guy I made the original agreement has been fine, but his girlfriend seems like bad news (taking out utilities in her name when I told her not to, which is fraudulent without owner permission according to the companies who set them up, and in general being obnoxious and irresponsible). So it is in many ways a question of our comfort level with having someone like that in the house and whether to continue month to month or give them notice immediately.

We’ve been renting out a furnished room in a finished garden level floor (he qualifies as a “boarder” in DoB terms) to someone we met through friends rather than try to rent it out as a private apartment or short term rentals through Air B and B. It has gone very well and the extra income helps a lot. He knew that a second person could not move in with him and utilities had to stay in our name (an informal agreement was signed describing him as a “boarder” renting a private room in our home. However, in the past month he has had a guest (a new girlfriend) staying over who is trying to move in and I just found a change of address note she had put in to the postal service saying she lives at our house. Isn’t that considered fraud (am in the process of researching)? Does anyone have leads on where to get solid legal advise from a nonprofit or other group, otherwise a reccommended attorney? I need to get a clear idea of what rights she may be trying to establish, what legal weight the agreement we signed holds, and what to do going forward. Thanks in advance.

Anyone staying beyond 28 days is considered a tenant and you have to evict them via the courts. They have tenant rights then.

Try the Met Council on Housing: http://metcouncilonhousing.org/ They have a tenant’s rights hotline you can call as well as lots of info on the site. I recommend Baron and Baron http://baronlaw.com/ I had to work with them quite a bit over the past year and I found both Baron and Mantell very effective.

Would not this tenant be on a month to month lease, formalised or not? Sounds like it is time to get them to sign a lease. Besides, if they continue to pay rent, what’s the big deal unless you don’t want that many people there in the “furnished room.” Are they using your bathroom and kitchen areas?

Don’t know if how you found the note is any factor but, would the post office be interested to know that someone who’s not on any paper work with you, is trying to establish a residence at your address? Sounds like fraud at a minimum to me.

Not sure what you mean by a singed informal agreement; I guess its not a lease and its bit more than a verbal agreement. But anyway, while they may be a “tenant” after 28 days, if your building is less than 6 units and they are not seniors, its not subject to rent control or rent stabilization requirements. Just move to evict both of them.

Not sure whether there is a difference between ‘boarder’ and ‘tenant’… If ‘tenant’ then has a right to have someone else living with him – crazy but true! Just do not renew ‘tenancy’ and both must move out. The ,tenancy’ will have either a month-to-month term or the term in the ,agreement’. Month’s notice required on month to month… Bu the way, no ‘reason’ has to be given for for refusal to renew term. Good luck..

Thanks for the above. I’m aiming to meet with a real estate attorney later today to sort this out and will post when I’ve got more solid information. Also, Met housing hotline wasn’t open yesterday but should be today. Though this won’t answer all questions raised above, the agreement he signed as a boarder (renting only a furnished room in our garden apartment with shared entrance and common area, but not a private apartment) said he would not have guests without my written approval. He didn’t have approval for the girlfriend to stay as a guest and apparently she put utilities (internet, tv) in her name without permission as well as putting in a change of address so her mail will be sent here.

This is a one family dwelling, so the garden apartment can’t legally be rented out as a private apartment though I understood from architects and attorneys a while back that, according to DoB code, we could legally have a “boarder” renting rooms (a term from long before the days of short term rental websites).

I’m surprised no one has mentioned this before, but why not ask him and see what the tenant says before going the legal route. That could sour an otherwise healthy landlord/tenant relationship.

It seems that, according to an attorney I consulted with, some of the things most alarming to me aren’t a big deal in legal terms, like the girlfriend putting in a change of address to my house. He said a boarder or housemate has tenants rights but at this point it’s a month to month arrangement since we’re beyond the initial three month agreement. If I want him out I need to give 30 days notice and can try to evict. I’ll speak with him before going the legal route, but am not sure having a tenant or two is worth the headache. Good idea to clarify rent increases in the lease if anyone besides the lease signer moves in.
