Looking for advice on the form of contract to use for a gut renovation. Do people typically use one of the AIA forms? Typical to hire a lawyer to review?

AIA form is common and often recommended by architects. It is not approved by the NYC Dept of Consumer Affairs because it is too protective of the contractor and not protective enough of the consumer. The DCA licenses Home Improvement Contractors, and requires us to have Workers’ Compensation Insurance and behave ethically for residential work. Others, are registered by the DOB for new construction, commercial projects, and to pull permits. They also must carry comp insurance. If you hire an unlicensed contractor to work on your home, only the contractor would be breaking the law, not you. If you don’t use the DCA contract form for residential work, your contract is not binding on you. I already paid for your lawyer to review the DCA form and to represent you in case of a dispute. Paying your legal fees is also a term of my license. I have not had a legal dispute with any of my clients, but my license fees pay the DCA lawyers to represent consumers in their disputes with licensed contractors, or unlicensed ones if they haven’t disappeared. If I had a dispute as a contractor, no city agency exists to pay my lawyer. You can see the DCA form and your consumer “Bill of Rights” at NYC.gov, select Consumer Affairs under agency. Of course, there are over 3 million existing housing units in NYC, and only 1,400 licensed Home Improvement Contractors. With the average HIC serving over 2,000 housing units. Obviously, the DCA has failed to license the vast majority of Home improvement Contractors. In my experience, my customer’s lawyers know about contract law and the UCC, but have little respect or knowledge of DCA law. Despite the extremely protective DCA, most home owners are unaware, or choose to hire unlicensed contractors, often encouraging them to commit insurance and/or tax fraud. Even when paying by check, contractors can pay 2% of your money to “turn it in to cash” so as to pay workers without payroll taxes or insurance. Price is what matters, not binding contracts.

The AIA forms should be the basis for a work contract. Along with certain AIA language additional project specific language should always be added in. A lawyer to review is only necessary if you feel that you cannot review the contract clearly. I have done many AIA contracts recently. They are the industry standards and have 100 years of legal precedents behind them. I recommend using AIA Form A-107 for a project like yours. If you want to have an attorney review the form (and that may not be necessary depending upon your project) find a good construction attorney because most attorneys have no experience in this area.
