Hi, I’m hoping that the Brownstoner community can come to my aid once again. I have a problem section 8 tenant- we went to court yesterday, judge gave her an additional 45 days to move granted she pay her rent. Well now of course she’s trying to get out that- complaining about construction dust. Someone claiming to be from the Dept of Health left me a voicemail today saying they came to the house and I was in violation. I never heard of the Dept of Health checking violations. I called the number back and it was a cell phone. I plan to call 311 tonight and check to see if there is a written violation notice. But wanted to check and see if anyone experienced a dept of health violation before. Oh this is an owner occupied two family.

I don’t think the NYC Dept of Health inspects homes. I would think a dust complaint would go to the DEP.

Dept of Health checks out dust/environmental complaints when someone calls 311\. They usually ask that the dust be cleaned up within a week or so. But they will come out again and check that they issue is resolved. If not, then they issue a violation for failing to comply with an order and you will have to go to an ECB hearing.
