Hello, My younger sister signed a lease over a year ago with two roommates, and our dad signed on as a guarantor. After the one year was up, they just went month-to-month, so no new lease. My sister now wants to move out in a few months, but I want to make sure she gives proper notice and that our dad is no longer the guarantor once she moves out. Any advice on how to properly do this? Send a certified letter to the landlord with 30-days notice?

  1. It depends on what type of guarantor letter you had notarized and what it says, some can go on for up to 25 years

  2. send certified letter to LL more then 30 days in advance stating that she will leave apartment in 30 days. Bring key to LL on the day of vacation and ask him to sign up the key handover paper.

  3. If the lease has expired, so has the guarantee, unless the terms state o/w.

  4. From what my sister tells me, I’m not sure this landlord would know the answer to this, so I just wanted to check what the right way to do this would be. I’ll suggest it, though!

    Seriously, tho’ you’ll have to get the landlord to sign something that takes your father off the lease. Why not just ask him?
