Hi there. We own a building, built in 1910, that does not have a C of O in the DOB records. We do have a paper C of O that came with the building when we bought it. I am wondering if there is a way to take this current document and get it in the DOB system, and have a more proper looking document associated with the building. Thanks.

  1. Just cycling back on this. Further research suggests the “letter of no objection” would be the best route. We do have what looks to be an “official” c of o on paper, event though it’s not in the city records. Given our goals and needs, the “letter of no objection” would work just fine, assuming those DoB nuts would see fit to grant it.

  2. If the C. of O. is for that building and is just not documented in BIS then take it up to the boro and have it certified and have them deal with it.

  3. I second the Letter of No Objection route. It just worked for one of my clients.

  4. raphael9 is correct. all brownstones do not come with a C of O, especially those constructed at the turn of the century.

  5. It’s also possible that the c of o is under one of the neighboring structures. If your house is part of a cluster built at one time, look up every one of them as the c of o is sometimes listed under the first house in the row.

  6. I would suggest that you apply to the DOB for a “letter of no objection” which is as close as you will get to them acknowledging it being used in its present form without having to file for a C of O.

    The application form can be obtained from DOB, the cost is $25.00. The process takes approximately 30 minutes, once you submit the forms it takes 3-4 weeks for a decision and you can see the decision on the DOB site.

My guess is that you would have to hire an architect or engineer to draw up existing plans of the house to verify that the current C of O is still valid and accurate and that present conditions are legal to the code for when it was built. It’s very possible that alterations have been made since the original C of O was issued. I highly doubt that the DOB would take the old C of O and just enter it into their system.
