I have a warehouse space that I would like to convert to artist studios (work only). Their is a C of O on for the ground floor (2 story building) for office/factory. The building is not in a historic distorict and is classified as: F9-FACTORY/INDSTRIAL

How difficult will it be to change the C of O from office factory to non-live studios if the building is up to code?

Is it possible to rent out studio spaces to tenants while waiting for the change of occupancy?

Any input or advice would be helpful.

  1. In this case the requirement of a change of c.o. will kick in if there is a change in use group which probably is because an artist studio is use group 9. Assuming you occupancy group or load capacity does not change (rare situation in your case) then only if you have listed u.g. 9 you will be able to get away with it without changing the c. of o.

  2. If you are construction / demolishing walls at the existing space, you will be required to file the project with the Department of Buildings. If no change is required to the C of O, this would be filed as an Alteration Type II.

  3. Just want to clarify something here. F9-factory/industrial is Department of Finance building classification, which is different from the use group on C of O. You should verify what says on current C of O, if there is one. Changing egress or floor area will require a new C of O, too, even you keep the same use.

  4. actually, mis-read your post; you’re making it sound like office is included under F-9, which I don’t think is accurate…?

  5. Yeah, I’m not sure how artists’ studios are different usage from ‘factory/office’. It seems like your real issues are going to be the buildout (egress, fire protection, per above). interested to hear the answers…

  6. Hi there, like the above comment reads, you should be. Fine in changing c/o if its required are u looking to use as a art gallery because theres no such use as artist studio in the z.r. But have your architect, engineer or code consultant research this a lil better for you

  7. This shouldn’t be hard, you need to verify that which zone is this and if it allows the use first. But are you sure you need a new C of O? What does the current C of O say?
    Assuming you are getting a new C of O. To comply with building code, there will be some work you need to do such as sprinkler, egress… and I can’t answer that without seeing the space.
    Sometimes it makes sense just build partial hight walls to separate the space and rent it out by desk. But again,it depends on it’s current condition and many other factors.
    And it is not legal to rent it out before you get the new C of O.
