We recently moved nearby an empty section that is fenced off. There is a padlocked gate.
“Active Driveway” has been spray painted on the gate. They don’t have a curb cut, so not sure how this can be an active driveway.

Is there anyway to tell if it is legally “Active”.

  1. @ for those who’ve been towed or wanting tows: You’re not supposed to be ticketed or towed from being parked blocking a driveway except for the following reasons:

    1 or 2 family house has a driveway and the homeowner or legal tenant calls 311 to have you ticketed and then towed. It would state on the ticket “Complaint by Owner.”

    If it’s a three family property or larger, a traffic cop can issue a ticket without a complaint since it is a common driveway. But if you have a vehicle blocking your common driveway, call 311. Traffic cops and tow truck drivers love the easy ones.

  2. They’re not supposed to tow your car unless there is a ticket on the windshield. Unfortunately, the traffic cops don’t carry around a list of the legal and illegal curb cuts so they probably relied on whoever called the precinct to tell the truth. Our condo building has a legal curb cut and we’ve had to call the precinct a few times over cars parked illegally. We now have a much bigger no parking sign. I got phone by the super one day, the cops were trying to find who towed a car over the weekend, I had no idea but directed them to the Navy Yard.

  3. I’ve had my car towed away when it was parked in front of an illegal lot with the same situation. It was illegal for them to tow me, but that fact didn’t help me much when I had to hand over $250 to get my car back. I complained to Consumer Affairs and DOT, but was never able to get my money back. So the only recourse in this case (if the lot is illegal) is to get it shut down.

  4. not take the sign down…but if parking on vacant land that isn’t a parking lot will get violation. Only guessing this is some fenced in lot….original post is not very descriptive of what they are referring to.

  5. My brother outside of Boston has a driveway, but he hasn’t bothered to either (a) have the granite curb chiseled down, or (b) replaced with an appropriate driveway curb. This is probably illegal… but after 5 years of driving two cars over the curb twice a day, the granite is starting to tilt down and become less of a bump.

  6. can look up online by the address to see if indeed parking lot.
    If not, call 311 with the address and complain is being used as parking lot.
