On what grounds did you get the recon? I’m very surprised the DOB gave you one as they are usually very strict about the bathroom requirements in cellars vs basements.
You need to submit a recon to ask. I had one approved recently, although they would only allow a shower, no tub for some reason. We also had to file a use declariation too. I also had one rejected in Queens that was 30 something years old.
