I received a SWO from the DOB for not having a Landmarks permit for exterior work that I was having done (no DOB permits were needed for the work).

I now have the Landmarks retro permit for the work so my question is, do I still have to pay the DOB $5000 to remove the SWO since I didn’t need the DOB permit for the work?

Also, is it pretty straight forward to have this removed myself or would this warrant an expeditor?

  1. Look up your property on the Dept of Building’s BIS site. You’ll see at the bottom ofthe listed any DOB violations and ECB court violations that would be your obligation.

  2. Is this an ECB fine? Did you certify that the correction was made before the date required by the Environmental Control Board? Is this the default judgement amount? I think the you have till the 23rd to take advantage of the “amnesty” program. Homeowner’s Night every Tuesday night 4;00 – 5:30PM at your DOB borough office.

  3. It’s usually best to use an expediter, but the $5,000 is a civil penalty for violating Local Law 58. You can request an ECB hearing on it, but once again, would suggest an expediter or planner from the Birectory.
