  1. Supreme Court oral arguments are just an opportunity for the justices to try to look smart and grandstand. Cases are pretty much decided on the briefs. The fact that Thomas doesn’t ask questions means very little.

  2. We have not had any good political arguments today, so I thought I would bring up a LA Times article from a few days ago about how Clarence Thomas has gone 5 years without asking a single question in oral arguments.

    There seems to be some minor debate over the value of oral arguments at the SC, but the rest of the justices participate.

    Any of the lawyers here have any thoughts?
