Slopey, we need more deep pocket defendants. I assume we can sue the MTA in addition to the City? Shirley, there was a nearby bus that made Biff trepidatious of stepping off the sidewalk sooner than he would have done otherwise, and that will also get him damages for intentional (or at least negligent) infliction of emotional distress.
May I suggest adding the EPA and FEMA to these lawsuits for not taking environmental action to stop the sleet from falling? And while we’re at it, what about the salt manufacturers who didn’t do enough to make sure their product was used in a correct and timely manner?
Does anyone else think the whole Groundhog day thing is a bit weird?
I think it’s strange that it’s an actual holiday and that we really “believe” that this little rodent can predict when spring will come….
Yes, winter outerwear that does not sufficiently aid in balance while the wearer is standing on ice is a defective product subject to strict liability under NY law. I smell class action, with SSCJ&L as class counsel.
Oh, and does death star own its building? We need the building owner and any management company, plus the contractor responsible for sidewalk cleaning and maintenance.
bxgrl, unfortunately she’s not doing so well these days, bad weather or not. Tomorrow is her 16th birthday, and she’s 4-6 years past her life expectancy, so it’s not surprising, but it is still very sad and very upsetting to watch.
