Denton, I did small claims connected with a holdover tenant — tenant doesn’t leave at termination of lease; you can’t accept money because you would then be entering into a de facto contract. So you win your case to get the person out, then collect in small claims court. You don’t need a lawyer, you go down to get a date, the other person gets a supoena to show up, assume you win, there is a judgement imposed on the other person.
Then YOU have to get the money. If the person doesn’t pay, they have a judgement which is outstanding which ruins their credit rating. If you have their employer, you can have their wages garnished by order of the court or if you have details on their assets, the court can order them to liquidate and pay, but you need to have all this info. In my case, the person understood what no paying meant and paid me.
