From the Forum: Is That a Legal Garden Apartment Rental?

Potential homeowners have an offer in on a two-family home but are concerned that the basement apartment may not be legal living space. In addition to making sure that the space is more than 50 percent above grade what else should they know about legal basement apartments? What risks are involved in buying a house where the space may not be legal?
