Question on Theoretical Ability to Build on Roof
We’re looking at a building and wondering how we can tell if we’re able to add living space on the roof. The listing has the following information: The zoning is R8B, Max FAR is 4 so available air rights are 2,230\. It is in neither a landmark or historic district. Is there additional info needed to determine the answer or is that sufficient? Finally, in terms of building on a roof, as I recall, if you duplex into a basement, the square footage of the rec room cannot exceed 80% (?) of the square footage of the apartment above. Is there a similar limit rule for in essence duplexing up onto the roof? Many thanks!

As others have stated, it’s hard to give an exact answer without knowing the particular circumstances of the building in question. Even if zoning allows for it, there are a ton of other considerations (engineering, fire surpression, egress, etc.) that may make it “fuctionally” prohibative.

See an expeditor, you cannot go by a general answer. It all depends on a ton of site-specific circumstances – zoning, width of street, required setbacks, neighboring buildings, etc. Do not assume you can use the existing footprint and go up.
