New Windows, Bad Surprise

Does anybody out there know NYC Building Codes? I live in a Brooklyn co-op. I installed new windows and the co-op Board ordered bars installed that prevent opening the windows. They claim it’s legally required. But no children live there, and I was allowed to fully open the old windows. They will give me a key to unlock the bars if I insure every Board member and every staffer, and accept all liability for any accidents or damage to the building, without burden of proof that said damage was due to my windows. I think this is all illegal, but can’t find anybody who knows building code and can help me. Dying for fresh air!

Hey, it’s been forever and a day since I lived in/was on co-op board (thank God, never again), but regardless of what the law requires, the Board can probably just determine to adhere to whatever provisions it wants to.

Board that are reasonable are generally open to hearing that their reasoning may be wrong. This does not sound like the case here. Even if they are wrong (and they may very well be) they sound like the type of Board that will just decide to apply it regardless.

So yes, go ahead and try to get that bulletproof brief decimating their rationale but it sounds like you’re up against a wall here (or a vent limiter). But I have had friends with similar experiences find that that type of thing just solidifies the Board’s position.

Doesn’t quite help your particular case, but every new high rise in NYC has the 4′ limit on the windows in lieu of the removable “window guard”.

Thanks to no-permitz and nyc_sport for useful leads. (LOVING this forum, BTW: loads of smart people & insights.)

So what’s interesting is that the vent limiter and child safety laws all apply to buildings classified as R2 or R3 structures in City lingo. But R2 is a walk-up bldg and R3 is a max 3-story one — my building is elevator, 30 stories, which I think makes it an R4. And none of the legal language in the code refers to R4.

Anybody know more about this??

I searched and went to several hardware stores — nobody has it, custom made. And they all warned that I could break the windows if I try to remove without custom key.

Window guards, the ones that you’re referring to are required for children under 11 and otherwise optional. This is different from vent limiters that the OP has which are now required on all new windows.

So window guards are ONLY necessary if you have a child <10 yrs f age living in the home? No kids in my home, of any age.... it says "The law requires that window guards are installed: "if you live in a building that has three or more apartments and a child 10 and under lives in your apartment, even if you live on the first floor."
