Renting a room to therapist/professional-non live in
What are the legalities to renting a room to a therapist/acupuncturist, etc? I want to rent the room, which has a private entrance, but not to a roommate any longer-just a professional who will use the room part time. It seems every brownstone has a therapist in the basement… Thanks.

Well, it really matters if you are talking about a single family house, whether you own or rent it, or a rental apartment, or a coop or a condo, and whether you own those. It isn’t clear whether the separate entrance is another door to you apartment (many old ones have two), or to your house (or it could be a house turned into apartments.) Because there are legalities with the city laws, which are often skirted, and then there are legalities with landlords and coop and condo boards, which may or may not be, depending on what they want to notice and allow.

Here’s what the NYC Zoning Resolution says. Home Occupation* A home occupation is a business operated by the occupant(s) of a dwelling unit, which is accessory to the residential use. It is generally restricted to no more than 25 percent of the floor area of the dwelling unit (500 sq ft maximum). Occupations that may generate excessive noise, odors or pedestrian traffic are not permitted. I’m assuming you C of O says residential, so technically an outside party running a business on your premises would be disallowed, but there are a bunch of therapy offices throughout Brooklyn, many exceeding the 500 sf and maybe the pedestrian traffic… And definitely not paying the re tax that businesses operating in commercial space are faced with….. We ran into the therapist thing with someone who wanted to rent or buy one of our residential co-op apartments. Thurns out they owned their own multi-family home nearby. We wondered why it would be ok for them to see clients at our place and not theirs and disallowed a non-residential buy for that among other reasons.
