Exterior Work and Insurance
I need to get exterior work done on our 4-storey building. But I’m terrified that someone will fall off (or drop something off) either the fire-escape or a scaffold we are likely to have to put at front facade. We have a good liability policy on the building but what else can be done to protect against an injury claim from a worker or passerby. I know I need to get certs of liability and Workers’ Comp from potential subs but I’m talking to people and hearing that that’s just not enough. Anyone have any expertise on this…?

You will need hire a special rigger licensed contractor to do facade work involbe scaffolding.Any special Rigger Licensed holder must have all insurance required to do any kind of exterior work with scaffolding.When you ask them about insurance certificate they will agree without any question.You ont need to check anything thing if you see Special Rigger licensed number just visit DOB website for license inquiry you will have the record. you need to know more about the safety. then you can require it from the contractor. when i had my work done on my brownstone house, I got those experience. I think you should call Zak> He is very expert. He will let you know what exactly you need. belive me you still need to know more and there are more information you must need to know before someone start the job. anyway i recommanding Zak. The contractor must have both liability insurance and workman’s compensation. Always be sure to ask the contractor to list you, the homeowner, and the job address as the certificate holder and additional insured. The sub-contractors should also have insurance and workman comp but if not, the contractor must put the sub under his insurance.

As a licensed and insured contractor, thank you for your question. The insurance you want (or one of them) is called “Workers Compensation.” It is a racket and many home owners understandably hire unlicensed, uninsured contractors, in part, to save money. Comp ads to the cost of labor by percentage of payroll. The percentage depends on the trade. Comp is required for all employers by state law, and applies to uninsured subcontractors as if they were employees. If a worker falls and is injured or killed from the scaffold, under a comp policy, they (or their family) make a claim, and they have no claim against you. A contractor’s General Commercial Liability policy protects you from lawsuit by a non-worker injured by something falling off the scaffold, just as Mr. Deboer describes above. I looked in to my policy when I realized the rates were going up from 10 to 20% of payroll and I knew many of my clients would not pay. I work exclusively on interiors, as required by my liability policy; mostly in buildings that already have C of O’s. According to NYC, safe to live in. Rates for interior trades such as I do are all about 10%, such as in a new building, where the contractor only does one thing. Yet I do more than one trade and sometimes I hire a licensed plumber or electrician. That put me in the 20% rate. My comp classification is the same as for erecting scaffolding and working high up on the outside of new buildings. All small renovation contractors operating legally pay double what they would pay, if they performed only one interior trade, as they only could if renovating many thousands of SF, or in new construction. Put another way, the owner of a coop apartment, who is forced to hire an insured contractor by management, is also forced to subsidize new construction, including: Atlantic Yards, WTC, condo towers, schools etc. If you are as pissed at this as I am, call your NYS assembly member, which regulates workers comp, and if you want more details, I will be glad to send you my recent testimony before the NYC Council Committee on Consumer Affairs regarding Home Improvement Contractors. I said un-just and rappidly-increasing comp rates are a disincentive to tax-collection, safe homes and work conditions, and consumer protections. Hire a NYC licensed contractor that has insurance. Have them give you the insurance with the building, board, tenants, etc. as being covered. If you have a contractor that has no idea then do not hire them as it will just get worse from then on.
