Work Without Permit Violation - Expediter / Firm advice to help cure

First post here. I was investigated and was slapped with a Work Without Permit Violation for removing a non-load bearing interior wall and capping plumbing on a 2nd kitchen. Fortunately I hired licensed contractor / plumber / electrician to do the job which was completed October last year. To cure the violation, I have to obtain Work and Plumbing permit. 1st question – Any recommendation on a firm or agency that I can work with to cure this violation? And the approximate cost to file appropriate paperwork (Alt 2 / Cert of Completion) to DOB? 2nd question – Do I need to contact the contractor that did the work to file permit? What are the implications on their part for doing work without permit? 3rd question – Can I lower the civil penalty fee of $5000 if I amend the violation before my court date of late April? Any advice would be much appreciated. I’m a renovation newbie and have learned from my mistake 🙁

jlpemberton1@aol.com. The fastest way is probably to file an LAA for the plumbing, & have the plumber thro removal of non-loadbearing wall on there as part of there renovation. The permit must match the scope of work. Then file a letter of correction as soon as you get the permit, at 280 Broadway. I don’t know if you have taken care of this yet, but the LAA process is the fastest way in regards to the plumbing fixtures. Also , you can always get an adjournment on the court date, if you should miss the cure date.

And yet when a crane falls over and kills someone or there is a gas leak and a whole building blows up people want to blame it on the DOB for not doing their job! It is unfortunate that for small jobs the cost for getting an architect, expediter, DOB fees, etc. is pretty onerous. I was thinking that the DOB could provide a service for homeowners with small jobs where you walk in and they fill out the paperwork and do a drawing on the spot for a reasonable fee. But it would never really work because people would give them inaccurate information like “oh, it’s not a bearing wall”, “we’re just going to use that space for storage”, etc. Even for a small change like moving a non load bearing wall there are potentially a number of code implications. When you move a wall you change the dimensions of two rooms. For each room there are code requirements for minimum dimensions, adequate light and ventilation, required electrical outlets, lighting, egress windows and smoke detectors for bedrooms, etc. So far the best way for DOB to ensure safety is by requiring you to use a licensed professional who can evaluate the relevant conditions and design something that meets code.

To expand on what was previously said, You will not only need to file paperwork as you said above you will need to file drawings for the work get approved, obtain a permit, get any inspections done that would be associated with the scope of work and obtain job signoff. As per the previous comment on public servants not caring about the public, and only being revenue collectors I could not disagree more. I am an architect and the majority of inspectors and people from DOB that I have dealt with care about human safety not money. That is what building codes are for and that is why there are licensed professionals, inspectors, and rules. Codes were not made because the city needed money codes where made to protect life safety and provide equal opportunity to the residents.

You need to find an architect/expeditor that can/will file the plans. If the contractors that did the work have access to licenses to sign off the work it will be easier than trying to find a new licensed contractor to sign off work that they did not do and cannot even look at themselves without opening up walls etc. again. You will probably not get very much done before the first hearing other than hire an architect and show that you are trying to make corrections. In future just be aware that “Public Servants” in this City are not there to serve the public, but are there as an obstacle cause to trip up the public, leading to Fines. In other words revenue collectors…. And now they are all tethered by the big brother computer it is getting even worse to find anyone that can actually help the public. The only thing worse than the Public Services is the Court System or someone would have been suing every department by now.

Unfortunately, I learned about “closed-complaints-after-3-tries” after I already called DOB to schedule inspection. (That letter is quite scary). I did provide a before and after floorplan to the inspector. Foolish me!

ah. OK, so I still can’t offer any help this time around, but as I recall from prior posts if you don’t make it easy for the DOB to gain entry they’ll eventually just give up. Did the inspector come by with existing floorplans of the building? How’d they know the work had been done?

A complaint was logged a week before I even started work. DOB came for inspection 3 weeks ago and left a note in my door to call and schedule an appointment. Called and had DOB inspect – and was served a violation a few days after 🙁
