Revocable Consent for Stoop Modification?

My current stoop has a fenced in front platform area that is three steps above the level of the sidewalk. Main stairs up to the parlor begin about three feet past the edge of this platform. According to my property survey, the property line starts at the foot of the stairs and these three feet of the platform are not on my property. I want to dig down this front stoop area to be at street level, but DOB is telling me that I need a revocable consent from the DOT. Any advice for resolving this? The actual property line and the fence line appears to consistent across my entire block. Tax photos show this platform being in place at least since the 1940s. Appreciate any ideas or suggestions. We recently did a revocable consent for a stoop. Yes, there’s a small annual fee, but there is also a “deposit” to the DOT for several thousand dollars. The process is lengthy, but not too difficult. It gets entered in the DOB system when as part of the permit application process. Feel free to contact me for more info.

The best way to handle this is to remove the stoop scope of work from the ALT1, or ALT2 filing at the DOB. Seriously, it will hold you up for months unless you remove it from the drawings.Then start to file it at the DOT. We offer those services, we have an engineer on staff. I’m sure your architect could do it themselves. The paperwork for revocable consent is small, but typically there is a small filing fee and possibly a yearly fee. You may want to consider just pulling DOT permits, because the work seems to be very minor.

Full schematics are attached to the original posting. In short, I will be lowering the level of the front stoop area and adding a dog leg to the stairs. All of this is within the existing boundaries of the stoop/yard that has existed at least before the 1940s. I believe this should be considered a grandfathered situation. I really want to avoid the revocable consent process — but DOB is raising an objection that we need to get one. Any advice on how to get this objection removed (without actually getting the revocable consent)?

In Brooklyn, the stoops have an interesting history, as they were built before the DOT. But the DOT has jurisdiction over some of them, but some are grandfathered. I’m not clear on the type of work you’re trying to do to modify the stoop.
