Question about violations

WHat is the difference between an OPEN violation and an ACTIVE violation? I’m waiting to close on a 2 family where there are two OPEN violations that apparently need to be cleared before closing From the DOB website: This property has 2 open DOB “Work Without A Permit” Violations and may be subject to DOB civil penalties upon application for a permit. These two violations are dated 2000 and 2002, how hard/easy will it be for the seller to clear them and mostly how long will it take them? We have a rate locked for another 3 weeks and then we are pretty much screwed…. My attorney is saying that we cant close until they are open, is that right? Is that a title problem or a bank problem?
