FYI - DOB now compelling entry with nypd?
Twice in the past couple of weeks now i’ve heard of the DOB compelling entry, with nypd officers present, for non-emergency (ie: no impending danger of collapse, flood, fire, or etc) things like non-permitted work, or checking for un-zoned basement apartments (vacant in the case i heard, but still present)- basically complaint induced, fines generating stuff. Both visits resulted in fines. One took place in queens (astoria) and the other in bay ridge – but the DOB seems to be getting some teeth now.

bond – could be that the nypd were present to insinuate authority through implication rather than actual verbiage – but nonetheless – that the DOB is bringing offiers along more often is still a change from what has been the norm. @curiosity – that’s actually not true – there are plenty of exigent circumstances by which nypd or fdny can enter your home with neither a warrant or permission – but almost all of them involve imminent and immediate danger to yourself or someone else. Where the DOB might get involved for instance, is if the complaint or their own investigation shows a risk of imminent collapse, illegal work being done that affects gas lines, etc… Either way – with the nypd over the past few years adopting a “ready, fire, aim” approach to enforcement, it’s not a matter of whether they “can” – of course they can… whether it’s permissable is up to the courts to decide after the fact lol.

I am by no means an expert, but I am going to agree with bond here. No one, and that is NO ONE can enter your private home without your permission unless they have a warrant.

I could be wrong, but it sounds unlikely to me. I know that on things like the old social club taskforce, or the fireworks taskforce NYPD brought FDNY along with them to gain emergency entry, they didn’t have that power themselves. Again, I’m no lawyer, but I’m pretty sure that NYPD has to get a warrant in most cases expect hot pursuit, screams for help coming from inside a place, that sort of thing. Now if you told me that DOB was bringing NYPD along under the guise of providing protection and implying that entry had to be granted, that I would believe.

I wasn’t passing judgement, simply using the term non emergency to denote the difference between the circumstances that the DOB *used to* be able to compel entry for, vs. what seems to be a policy change, and a more aggressive crackdown on such things.

If this is true we should keep in mind that some “non-emergency” violations, like ” un-zoned basement apartments” _are_ an immanent danger to people’s lives (that of tenants and, possibly fire fighters).
