Clearing 20 year old violations?
We are just about to get our permits for our reno, and we were told that they will likely be held up due to 2 twenty year old open construction violations. One is “work with out permit”, and the other one is simply listed as “construction”. The BIS service lists no other info, other than the date and violation number. We do have an epeditier, and hopefully they will be able to handle this in a timely manner, but any tips for ways to get this kind of stuff cleared ASAP? We really don’t have any idea what they could be, as everything is in good shape inside. Thoughts / tips?

OK so I have more info on our violations. Both violations are about an illegal curb cut, and a car parked in our front yard. There is no evidence of this on our current front yard other than a wall that was clearly built at a later date. We have no idea when this was remedied, and we have already supplied photos proving that it’s fine. The DOB insists it still needs to send out inspectors. We may be held responsible for a fine…any idea what the fine could be for something so old? There is no work to be done to remedy this…no idea what to expect.

you will need to get a permit for the work and then you will most likely be charged for the work without a permit, this charge will be crazy. The charge is calculated at 14x the original fee. We recently went through this, we bought the building 2 years ago, some time in the 80’s the super redid his apartment illegally. Now we are doing new renovations and an inspector came by and looked in the apartment and saw the work was done and no permit was ever issued. They have records that go back 40 years. Anyway they gave us a fine and made us pay $20,000 to get a new permit to get rid of the violation. It is a racket. Just be prepared.

I had a different experience with a property I did not own and had not altered. A crazy neighbor complained, and I appeared at a ECB hearing. The charge was “building without a permit.” My neighbor wanted control of a property, which he did not own or rent. The inspector was illiterate. The judge was senile. Nobody had a copy of the code in the hearing room, where all sorts of non-dob cases were decided too. “Building without a permit” was the most general code violation used when nothing more specific applies, because a complaint was received without evidence. The charge was dismissed. I am not an architect. I never owned the place. I held a commercial lease. My landlord did not bother to appear himself. This was about 15 years ago. I don’t know if anything changed in all these years, but if there was no work done in your case, and the charge was also BS, and you can prove it, then they may have no evidence otherwise, they may not know what the charge means, and don’t expect you to dispute it. Maybe you can persuade them you are not building without a permit now, and nobody else altered the property then. Unless, they built something without a permit…

DOB may have a record of what the exact violation is, if not, it should be cleared by taking out the permits and doing the work. Your architect or permit expediter will need to take care of it.

someone (architect or PE) needs to take ownership of the open permits to close them out. work WO permits: new drawings need to be filed, permits obtained, and contractors need to take ownership of the work that was done.. of course need expediter too. http://expediter-nyc.com
