Anyone permit a steel deck a floor above an illegal one?

Have any of you seen a successful permit closing out for a steel deck built at the same site as an illegal apps deck? We have permit approval for a steel deck we are about to have built and I’ve gotten mixed feedback as to whether we will have a problem on inspection for sign off. We have an architect who didn’t seem worried not did the expediter but they said it there is a risk but it is small. I’m going to ask our architect again but a possible contractor said he expects us to have a problem on inspection unless the architect self certifies. But we have multiple inspections since we are also adding a kitchen. Thoughts?

If you have a permit, just follow with the work that has been “permitted”, get proper construction documents, like steel drawings and specs from a structural engineer and you should be alright, unless, your architect/expediter tricked the DOB into issuing a permit for a work that’s not code compliant (very improbable, but sometimes happens)-then an inspector may pick this up. Still the permit is a very good shield of defense.(see 1st line)
