Tenants want to have wedding in backyard -- What kind of insurance is available or should I require?
They have the ground floor apartment with a large but rather “rustic” backyard. They are very nice and I want to accomodate them. I want to cover my a**. Any companies etc? Thanks!s

You should call your homeowners insurance and inquire about event insurance for a wedding with ‘host liquor liability’, and have your tenant reimburse you. Work with your agent to find the gaps and limits in your liability. Depending on the size of the guest list, and the limits those policies cover, it would be very wise to take out an umbrella. (living in nyc without a generous unbrella is unwise IMHO, but from talking to a lot of homeowners most seem clueless). I would not do any less than $10 million – but not knowing if the guest list is 200 vs 20, its really hard to give an (unprofessional) opinion. You are still on the hook for drunk guests after they leave. Price that and see if you can get your tenant to pay for that (for the year) as well. They are saving a small fortune by not renting a wedding space. I would not neglect the fire code either. You should stop by the local fire house and make sure they are on board with guest count and egress, etc, ask if they need to do a walk through, be aware of the date. The last thing a wedding needs is the FDNY showing up and dispersing the guests.

At a minimum, make sure you are named as additional insured on the liability portion of their renters policy. Per slopefarm, your broker may have some additional thoughts, like requiring them to take out a separate liability policy for the event. A friend used another friends’ property for his daughter’s wedding. The property owner required them to get special liability insurance. As it turned out, a wedding guest fell and broke her hip. Both the owner and the wedding host were protected. @cmu – but I am sure if one of the tenants or the tenants’ guests had an accident in “their” space, they would immediate contact you and sue in an effort to assign all liability to you. I think the OP’s tenant did the right thing. Bring attention to the landlord for a special event and see what issues there might be.

It’s not their exclusive space, and the yard is quite large–1700 square feet, so it could accomodate a lot of people. I’m not worried about them so much as Aunt Betty…. Thank you for your answers!

Wow, I don’t think any tenant of mine would’ve dreamed about asking permission for a party *in their space.* And I wouldn’t expect them to. Your tenants are going way beyond the call of duty. Coddle them.

Does your lease require tenants to get renter’s insurance and do they have insurance? if so, are you named as additional insured on the tenants’ policy? Ideally, you want to be in a position to refer any claims against you arising out of your tenants’ party to tenants’ insurer under the tenants’ policy. Worst case, you refer to your homeowners’ policy and let the insurers fight it out. This is a good question for your own broker in terms of how your existing homeowners’ policy would handle it.

Let them do the research and show you proof of insurance when it’s taken care of. They can get it for the entire wedding to cover their own arses as well. http://wedding.theknot.com/wedding-planning/wedding-problems/articles/wedding-insurance-101.aspx It can’t be a very big wedding if it’s just in your backyard, so you might want to think of it as any old party. You can also require that the vendors have insurance. I know that I’ve needed it a handful of times as a wedding photographer.
