Seprate parlour floor to two room

We just got three stories townhouse. Its two family and would like to divide the two family in the middle. what I mean is that: 1 family is garden floor +one room of the parlour floor 2 family top floor and the room at the antrance of the parlour floor. we will have to put a wall in the center of the parlour floor and it will be great for us. my Q is it legal? or there is some safety codes I have to deal with or permits. anyone done it? thanks

Changes in C OF O’s are usually modified when there’s a change in user group or occupancy. A permit will be required & an aspestos inspection most likely. I’m not sure, but they may ask for an updated survey plan. The DOB ask for a lot, so you should think about all the things you want to do, so u dont have to go thru this process again. And if there’s electrical work than that will need to be signed off on as well. jlpemberton1@aol.com

I think what Deboer is pointing out is that the C of O will technically have to be adjusted since the dividing line between the occupancies is being shifted.  Your parlor floor which was formerly entirely part of one occupancy is being now split between the two occupancies.    I have not actually seen a C of O updated to reflect this in the past, and I would be interested to hear from anyone that has actually had to go through this, considering that you are going from 2 family -> 2 family.

I agree with Deboer. You will need an architect or PE to draw plans, and a licensed contractor to erect the wall. Then you can get a new Certificate of Occupancy. Feel free to contact me if you have questions or need help.

Yes, fire separation between the units would need to be maintained and you will need a permit and update the C of O as well.
