Question for all you code junkies out there -- Deck depth greater than 8'?

The DOB nixed our 10-foot deck, saying it could only be 8 feet deep. The way I read the code, it can extend 8 feet into your “rear yard,” which is 30 feet from the rear of your property. So if your actual yard is 40 feet, you should actually be able to build an 18-foot deck (if you could afford it!). Anyway, I’d like opinions on whether that interpretation is correct, and on whether there are other codes (such as a ventilation requirement if you have a tenant apartment underneath??) that would prevent the deck from being deeper than 8′?

You’re right in that the code does limit it to 8 feet into the required rear yard.  However, most examiners interpret it to mean 8 feet only.  We usually get them to accept a larger deck if we can include it in lot coverage and still stay below the max lot coverage (55% in R5 and 65% in R6).
