Coop Share Stock Certificate
I bought into an HDFC coop in Harlem about 19 months ago. I paid off my small loan in July 2011 and a still waiting to receive my Share Stock Certificate. The board claims we have no money to pay the lawyer. Would anybody have advice on how to enforce receiving the share holder stock certificate (title) to my proprietory lease? In addition, I would like to know if shareholders can be refused information on who are actual owners of the units in the building. I know that the coop attorney company should keep records on ownership, such as purchase history etc. If I approach them, would they be obliged to provide me with a copy of shareholder names? I have reason to believe that our coop has enabled non-sharehoders (renters) to vote and to actually be on the board. Is there possibly a public office, such as HPD, who would have copies of records share holder stock certificates. Thank you for any insight.

The info you are asking for is not public at all. What I would do is send JLP a letter by certified mail and cc the Attornerys General Office and file a complaint. Google this link: http://www.ag.ny.gov/resource_center/complaints/pdfs/ref_complaint.pdf You are going to have to build a case in writing if the information you are asking for is being held hostage. I would also reach your priot lender whom you paid off to inquire about what “servicing documents” they may have copies of that you may be able to get your hands on. All lenders that service co-ops have a dedicated department, because co-ops are complex.

The management company, JLP Metro Management Inc., which has just recently been hired by our board is not forthcoming. In fact, at a recent meeting when the owner of the company, Anton (Louis) Popovic, introduced himself, he stated to take care of the SSC matter. However, when I called him a few days ago, he denied any such statement and said that the board will take care of it. The board always says they will get it done but don’t. Unfortunately, our board fosters a culture of secrecy. In fact, a new share holder is still waiting to have her name added to the intercom menu (telephone entry and access control system) after living here for over six months so that she can not be reached from the front door nor buzz anybody in. Needless to say, this is a security issue as well as a nuissance. The board played the same power game when I moved in. Do you know where I can receive a list of share holder names of our Co-Op and whether I am entitled to know who the actual share holders are? I would like to prevent non-shareholders to occupy seats on the board. Thank you.

What does the management company say? There is no public site with the information you are looking for. You are suppose to receive your SSC. You are a share holder.
