What exactly has to be listed on the C of O? Balconies? Back Yard Decks?
I can’t seem to find anywhere the specific answer of what has to be listed on a Certificate of Occupancy. The C of O for my building was filed well over 30 years ago, and is a single page listing only the number of units on each floor. The lease assigns balconies, back yard decks and roof areas for decks to specific apartments, but there’s no listing on the C of O for any of those things. What information EXACTLY is supposed to be listed?

In most cases a Certificate of Occupancy is tied to an Alteration Application for work done that was the basis for the new/amended C of O. The Application will have drawings that document decks/balconies/etc. As other posters have noted the C of O only lists floors and occupancies. The details of layout, exits, rooms can be found on the drawings which are on file at the DOB.

It seems to me that what you are looking for is the record of the division of rights to spaces between your co-op/condo units? This you will find in the original co-op / condo plan, prospectus and in any amendments etc since the original co-op/ condo plan closed (the conversion). You should have got copies of all this when you bought your unit. If not ask the Attorney that you used when you bought it what happened to it. If you cannot find it there, you can get a copy from the management company or your board for a fee.

The C of O ONLY spells out how many units there are in the building and how they are divided by floor. It will say nothing about roof or yard rights, ever. It will never mention balconies, decks or terraces. Don’t attempt to amend your C of O to list these sort of rights. I don’t know what arch111 is referring to and doubt that he does either.

These backyard decks are ground level with dividing walls with doors (between each deck) and then there are some units with balconies. They’ve been there since the building was converted in 1981, but the 1981 c of 0 only lists the number of apartments and the total number of rooms. How could this have happened then? Wouldn’t there have been a final inspection to file the final c of o back in 1981 listing all spaces? Also the top units have roof rights in the lease and there have been decks up there for 15 – or 20 years or so. Were the laws different then? If so, is there a way to get it amended easily w/o it taking a year?
