survey report

ok this is for the hardcore super brownstoner geeks! we just got the survey back from the title company on the house we want to buy in bushwick and the front gate and stoop is encroaching onto the sidewalk by 5 feet! which is strange because the house is totally uniform with every other house on the block. I do not understand how the last owners bought it with this issue last year…and how they are going to deal with it with the city….My lawyers (who i am losing faith in more and more each day) are “looking into it” but i wanted to get some answers from you guys

Don’t give up on your attorney…saying they will look into it is a far better answer than “it is typical, don’t worry about it” … it means your attorney, if they do follow through and look into it, will make sure everything goes smoothly for your closing. (As an attorney, that’s the answer I’d trust.)

My house in Queens is the same way, my architect told me the city has it this way in case they decide in the future they want to widen the street, they have additional space. Not sure if that’s true, or how I’m going to make it up my stairs with a higher incline, but yeah it seems “normal”, my whole block is like that

I had this issue with my property. The stoop/steps were rebuilt in the early 80’s. It became a problem because I filed to change the c/o. They allowed it because I had an old tax photo from the 30’s that should the original stoop came out that far.

Half of Brooklyn is like that. And yes, it’s uniform with every other house on the block and they have the same legal situation and have been living with it for years. The only thing you have to worry about is your clueless lawyer.

You lawyer should not have to “look into it” if he has seen the survey and is proficient in Brooklyn real estate issues/laws. He should know right away what issues there are, if there are any, especially if he has arranged the title company for you to use. Encroachments are not that big of an issue typically. But unfortunately I canot answer the question specifically.
