Ridiculous Sanitation Citation

Part vent, part request for advice. Our 2 family just received a $300 citation because of ‘some napkins observed in the street less than 18″ from curb’ – that is a quote, and that is ALL there is in the complaint. Not only is this our first citation; not only do we maintain our garbage exquisitely with two brand new bins; but we are the only folks on the block who actually are out sweeping both our and our neighbors’ sidewalks twice a week. The houses on either side of us are messes, and there is no public garbage can on any of the adjacent corners, so we get stuck with lots of windblown debris. High dudgeon says we will fight this to the supreme court, as it’s the most baldfaced piece of extortion I’ve experienced in 20 years in this city. Our Councilmember has already been contacted. Your words of (dis)encouragement are welcome.

Got three tickets like that, got them dismissed every time by replying online and attaching pix of the clean sidewalk and saying i take good care of cleaning up. The same ECB guy was coming every week and giving me a ticket, not quite sure why they would use such technique…

Its totally random. I have usually the neatest recycling on the block, but seem to be the only one that gets a ticket for the smallest infraction while my neighbors rental property has messy trash, put out on the wrong day, left for days and blowing all over- I got a $35 ticket because after breaking down all the cardboard and neatly putting in one box so it was an easily managed, tightly packed and a perfect cube- I didn’t put a completely unnecessary piece of tape across the top. I recently realized that much of the litter we see is coming from cars. They either clean them out by throwing everything into the gutter/street/sidewalk or dispose of whatever trash they have have as they enter.

“…and hand out a tax like this …” – I think that’s the bottom line. You pay your property tax and you pay city income tax and then on random occasions you pay a bit more. The BS sanitation ticket, or the parking ticket for when you’re late moving the car for ASP, or a summons for “in park after dark” (who knew you could get a ticket for being in the parade grounds after dusk?) If you have the time and energy to fight it, I wish you luck. Inconsistent enforcement won’t work as a defense. If you see the sanitation worker who writes the tickets on your block, tell them (nicely) that you were unhappy getting a ticket given how much effort you put in to cleaning up in front of your house and your neighbors and they’ll probably leave you alone from now on.

It is possible one of your neighbors reported you, since none of the others got tickets. (Can one do this with sanitation?) Perhaps the one whose tree pit you regularly clean, perhaps another. No good deed goes unpunished. And ornery messy people don’t like others who make them look bad.

We didn’t get a citation but one weekend some contractor dumped all these used ac filters on our sidewalk. I was going out to move them into the corner trashcan (about 15 feet away) and saw some woman through some cardboard boxes out of the trunk of her car on top of them. Well she wasn’t quick enough. I ran right over and threw them right back in her car…..

I’m perfectly aware it’s our responsibility – that’s why we sweep twice a week. I’m not sure how an enforcer is allowed to follow a breeze down the block however and hand out a tax like this and be in any way consistent with the law. The rest of the block didn’t get any of these tickets. And I can promise you that while that napkin blew by our house, the neighbor’s tree pit was piled with litter that’s there on a monthly basis, until we finally go over there and clean it up for them.

Yes, it’s ridiculous, but refuse within 18″ of the curb IS your responsibility, so you might end up having to pay this extortion, err fine. However I hope your council person will be able to help. Fortunately enforcement of this rule is pretty inconsistant, so you may never get another ticket like this.

It’s worth contesting the ticket. Take pictures of the street even though it’s not on the date of the citation. Also take photos of how you organize your rubbish & recycling. At the very least I’d almost guarantee you’ll get a reduction of the fine.

I’ll rant with you. I witnessed a woman getting into her car, just take her stroller and dump all the trash in it onto the curb of my neighbors house the other day and tried to nicely (if that’s possible in this situation) tell her that she should clean it up. Of course she was a total entitled bitch about it so I just walked away instead of staying to listen to her berate me, but people are constantly dumping trash out of their cars near us (we live near a park with lots of park visitors parking on the block) and there’s no way to keep up with the clean-up. If we end up with a ticket like yours, I will also be steaming and probably hoping to hear that you had a decent outcome with yours. Good luck!
