Mother and daughter in Co-op

Hi, My ex-wife and daughter lives in a 1-br coop. My daughter was born and raised from that apartment. She has graduated from college and is now working. But my ex-wife wants to travel indefinitely abroad (maybe 1 year to 2 years) and leave my daughter to live on her own in the apartment. Since the coop is under my-ex-wife’s name only. The coop board wants my daughter to apply to sublet the apartment. Is this right? I’d appreciate for comments and suggestions. Thank you.

Check the proprietary lease. In light of the Board’s current position, this might also be a good time for your family to clarify ownership issues. For many co-ops, inheritance of shares does not automatically confer the right to occupy the apartment.

If your daughter has been living there all along and your ex-wife is not moving her primary residence elsewhere; she is not actually moving out, just traveling? I do not see that the co-op board can claim your daughter is a sub-let. Under NYC residential occupancy rules, a spouse or child is allowed to live in the apartment. One un-named (not on lease) roommate is also allowed to live in the apartment. If the co-op is a Government subsidized co-op, then you might have an issue. Especially if your daughters income does not fall into the guidelines for the unit. Consult the Co-Op rules and regulations, the proprietary lease and the original filing plan, if you can find it. And if it is still not clear, consult a co-op lawyer specialist.

See what the proprietary lease says, but it has to confirm to what NYS Real Property Law states, which applies to rental tenants and co op leasees alike. If it were me I’d ask a lawyer his/her advice, it seems the stakes are sufficiently high.
