Is a legal 2-family brownstone/townhouse required to have a sprinkler system?

It’s a legal 2-family, listed as 3 stories with a garden level. No commercial use. Any insight would be much appreciated!

Thanks for all of that. So it seems that unless you are changing the C of O it is not a necessity.

As housepoor mentioned, you may be required to add sprinklers if you’re changing the number of families. However, to elaborate, going from 2 to 1 will not require sprinklers as they are both the same use group. Going from 2 to 3 will, as will going from 3 to 2 in most cases, because that’s changing use group.

If you are looking to change use — including going down in units — you may be asked to install a full house sprinkler system. I proposed a change from a 3 to a 2 family (and in the process add a penthouse) and was told the existing hallway sprinklers were not adequate and I needed to sprinkler the whole house. It killed the idea.

I believe 3 family or more requires a sprinkler system and fire escape. A two family should be exempt. Maybe someone else will reply to confirm.
