Installing a new kitchen in illegal extension?

I am interested in this brownstone that has illegal extension towards the garden area that current owner is using as a bedroom. There is no kitchen on this level. Because it’s a legal 3 fam being used as 2, if I want to I can add a kitchen on this level. Would I get into trouble trying to get permit for this?!

Who is saying that the extension is illegal? Just because it is an old extension that no one can readily find a filing for; does not make it illegal. Did the current owner add it on illegally? In which case, you might well have a problem getting title insurance for it. A Bank would certainly not put a mortgage on it if the older title searches and surveys do not show it.

I’d be careful here. dibs is assuming that DOB won’t question the extension if you file as just renovating an “existing” kitchen. But what if the plan examiner is curious? You say it’s a 3 family, so there’s likely an HPD I-card on file that would show the layout of the original – and may also show that there was no extension if it hadn’t been added when I-card was done. Since the C of O allows for it, just pull the permits for a kitchen renovation and do it as a renovation. Do not file it for an added new kitchen. Most houses in brooklyn have illegal extensions. Usually they consist of no more than an entranceway to the rear door but yours sounds bigger. It should not be a problem. Alternatively, you can do it all without permits as many do, neighborhood and neighbors permitting.
