How to check if a curb cut is legal?

My neighborhood in Bushwick has a lot of what appear to be illegal curb cuts (or no parking signs painted over regular curbs)… but the one that irks me most is a small house with a narrow driveway too small to park a car. The owner has spray painted a “reserved parking” zone out in the street (because he can’t fit a car in the driveway) that extends several feet in both directions past his curb cut. My question is: what city agency do I check with to see if the curb cut / no parking zone is legal? And if it turns out not to be legal, is there anyone who can do anything about it? thanks!

A permit for a curb cut does not show up on the building dept. It is the Department of Transportation that issues those permits, but once it is signed off, you cannot access that info on any public web site. If it is a legal curb cut, the parking signage will be NYC issued; not Gerry Rigged signs, holding spaces for individuals. Call 311 and your local community board.

Firstly, it’s illegal to paint a City curb or street and 311 will take a complaint about the painting. If there’s no curb cut, there’s no driveway and you can legally park. If there’s a narrow driveway imparctical to use with a garage in back it’s a legal cut that you can’t block. Curb cuts for front lawn parking are almost always illegal and rob legal street spaces from drivers. Call 311 if you suspect an illegal curb cut.

Yea, I would park there if I knew for sure that it was legal. Part of the “reserved” space is still a curb cut. I doubt the cut is legal, but it still seems prudent to verify first.

Why don’t you just park there? The police don’t look at paint. If there are no official NYC signs and no curb cuts, you won’t get a ticket.

Thanks mozeeatupu! I did look in the BIS but I wasn’t sure how to tell if a curb cut permit should even show up there. I looked up a couple addresses with legal cuts, but I don’t see anything that looks relevant under “Permits In-Process / Issued” Master Plvmber – that’s exactly what rubs me the wrong way. His actual cut is about 5′, but he’s painted a 15′ box in the middle of the street(!)

For what it’s worth, there is no such thing as any City agency painting curbs any color for any reason. That is strictly done by individuals or businesses in an effort to mark what they want you to think is their territory.
