Day Care Help!!

I currently live next to a Day Care and it is driving me crazy. I love kids and I understand the need for day cares in nyc, but I am having a huge problem. I have looked online to see if this day care is licensed and it is, but it is only allowed to have 12 children. The daycare next to me has 24 kids!! My understanding is the people that run the day care also have to live where day care is being held. These people do not live there at all they are running it as a commercial space. I don’t know what to do. The noise level is out of control and since we share a common wall, I hear everything. I have contacted the owner over and over to please try and make it sound proof but he chooses to ignore me. This day care is 7 days a week so I get absolutely no break. I can’t enjoy my backyard because there are kids screaming all the time. I currently own my home or I would just move. I find this truly unfair and don’t know what else to do. Any suggestions?????

Call the Dept of Health, if you believe this is an unlicensed day care they will come and investigate. There are strict rules regarding the operation of a day care, from size of space,ratio of caregivers to children, egress, etc. In any event, if this is an unlicensed, day care it is putting children at risk.

Thank you so much for all the suggestions. I’m trying everything!! I feel as a homeowners we don’t have many rights when it comes to Day Cares. They are really needed in this city which I get, but it really effects my daily life it is a bit frustrating. These people have now connected the basement floor to parlor floor so it is two levels but they have boarded up the front windows on parlor floor so you can’t see in or tell what they are doing. The owner of the building really doesn’t care because he doesn’t live there full time so he doesn’t have to deal with the noise level. I just don’t see how anyone could put 24 kids in a home and think its not going to disturb your neighbors. He really doesn’t care which is obvious. I have hired a lawyer to deal with the city and see what can be done, but the city is for day cares so its a very hard thing to fight. Now I have emailed our city council person so we will see. There is huge money in Day Cares these days: Someone wanted to rent a garden/cellar duplex in one of my houses in Fort Greene recently for a Day Care, the residential, normal tenant rate I was asking was $3,500\. They offered $5,000!! and were very sure that they could take more than 25 children a day with 3 full time adults and make ” a ton of money”. Just the thaught of 25 kids being cramed into the cellar with only 750 sq feet above ground level scared the hell out me, they offered me more money… They charge $50.00 per day per child… what kind of parents would put their child in such a cramped obviously not properly equiped with the right plumbing etc. space? The owner next door to you does not care about you, because they are making money beyond what the space is fit for. Care about the kids, not the Greed! Call them out!

I bet if you write the owners a letter and tell them you know they’re handling more children than they’re licensed for, they’ll listen. Because the city will come in and close an operation like that down in a heartbeat. I live near a day care center where that happened and the alleged infraction wasn’t even as egregious as what you’re describing. Also surprised that it’s open on Sundays.

Why don’t you talk to them again & tell them you’re going to report them for infractions if they don’t work w/ you on the issues?
