What is the minimum height from floor to ceiling in the garden floor apartment?
I’ve heard that is a minimum of 8′. What would happen if it was one inch shorter? We will need to pass the inspection of the DOB because we are getting a new C of O. We are putting radiant heat and we are losing that inch and or inch and a half. Any info will be appreciated. The photograph is just for illustration purposes. It’s not our apartment but it is a similar garden floor apartment.

  1. 8′-0″ minimum for habitable spaces. You may try to say that a certain percent is non-habitable and you have left enough sq. ft. for habitable in case inspector picks it up but it will be up to the plan examiner to accept it.

  2. six years ago you could have passed an inspection with a nuclear reactor in your basement. but that was six years ago.

  3. My garden level is 7’10” and I got a 2 family C or O with new 2 story addition 6 years ago with no problem. I have hydronic radiant in the new addition and love it.

  4. Do you have a choice NOT to use radiant heat and avoid the issue and any related risk? Radiant heat has all sorts of other problems other than the benefit of even distribution and no visible equipment.

  5. 8ft is correct, but u should be fine wit your inspection dont worry
