have a tenant that once again has created a lot of water damages. they knew that they were not suppose to use a home made utility. I just finished replacing the roof on the second floor from a leak under their bath tub. which cost 700 dollars to fix and re- plaster the ceiling. the time before they caused 2000 dollars worth of damages but I was unable to pin point the source of the water. They are rent control with no security deposit. what can i do? ive contacted our lawyer but have not heard back from him

  1. we tabulated the cost of everything and it is insane! and considering they were told not to put a garden hose on the plaster wall …….we are going the legal route and taking them to court. I hate this but they just threatened me for nit fixing things when I have this months receipts showing 700 dollars of repairs to their bathroom and now the walls are destroyed again.
    Its just sad that peoples arrogance can destroy property and they still feel above reproach.

  2. What kind of “home made utility”?

    At this stage, it sounds like you want to start by reading the DHCR fact sheets for owners (They’re available online at http://www.dhcr.state.ny.us/Rent/FactSheets/ ) and start putting things in writing (“On this date you violated your lease in the following manner, causing damage which cost $xxx to repair.”) and keeping receipts.

    If they’ve installed an appliance w/out permission, you can tell them it needs to be gone. Follow that up with a letter and keep a copy. (“Pursuant to our conversation on Jan 10, 2011, you are to remove whatever it is before the end of the month.”)

    And, while you’re on it, make sure you understand your responsibilities and their rights. Don’t put yourself in a position where they can accuse you of harassment.
