Are there any legal ways to remove tenants immediately without having to go through the eviction process? For example if they are committing crime, the police come and arrest them for murder, being a drug dealer, threatening to kill me, terrorizing,etc? (I’m being a bit silly maybe but just wondering if anything can speed along the process of getting rid of a tenant)

  1. You can buy the tenant out. That is the fastest route. Make sure you have them sign a letter of no harassment on the way out the door.

    Otherwise, you are stuck with the legal process. Even though you may want them out quickly, it will come back to haunt you if you do not do it legally, ie. when it comes time to sell or file for a work permit, etc.

Having been a process server for over 20 years i can honestly tell you that if you can get the police to prove illegal activity ( drug dealing prostitution or the like) is going on in the property and they make an arrest you can ask the DA to help you file a RED JACKET L&T eviction that allows you to throw them out alot quicker than going through the waste of time that is the NYC housing court.

  3. If the tenants are rational, cash usually works. If they’re crazy, it’s a long and winding road. Good luck, you’ll need it.

  4. An arrest would obviously get them out of the apartment for 24-48 hours. After that, you would have a very angry tenant.

    I am not sure if you could get a restraining order excluding them from the apartment (unless maybe the crime was extremely severe and you lived in the same building).

    And even if the tenant was arrested, I don’t think that would give you the right to evict them (i.e., throw their stuff out on the curb) until you get a court order.

  5. Tenants are protected from landlords being able to toss them out summarily.

    Your coop, however, does have the right to throw you out for objectionable behavior without legal process.

    Even if your current tenant is horrible, remember, the next tenant is also going to want heat.

  7. nothing legal. my sis once had a crazy tenant who stopped paying rent, lit the trashcan in the apt. on fire twice, and still managed to enjoy rent-free living for 9 months before being evicted.
