I have a violation on a 3 Family building from 1961? I’m currently doing renovations and wondering what was the procedure to drop that violation. I stopped by DOB once and they said that since it was so old they could just drop it. I don’t know what the violation was for and I think the last time I read the forum they said they was a form that I could use, but I couldn’t find the form or the link.

Any help is greatly appreciated.

  1. Just because a violation is old os not a basis for removal but sometimes if the codes of the violations haven’t been used for the longest time it may get removed without any major action. If it is from prior tothe 80’s in general you may be able to get it removed without an inspection as they don’t have copies unlesas if it has a listing as a BMD violation. otherwise you will need to get a copy of it and adress the situation listed on the citation. email me the address and I will take a look.

  2. They probably have no information to back up the claim of a violation. Try to get a form from DOB that says you have cleared all violations as of a certain date. I called DOB for this before and they were helpful. I had to snail mail a written request for a list of all violations and a money amount to clear them. I sent in a check and a few weeks later I got the form from them. Let us know how it goes.

  3. There are expeditors who do this all day long. they are usually former DOB employees who can research, submit fines (which you may need to pay) and close out old violations. I do not believe DOB will just waive them. Most architects know one or two as do most GC’s. It will cost you but well worth it. Try to negotiate a flat rate not a by the hour. If so, try to get him or her to cap the fee at a maximum.

  5. Your architect needs to address the violation on the drawings that you submit for permit. The permit application will list the violation number.
