I had a 421(a) tax abatement application filed in July 2007, an amendment (correction) was made in December 2008 and “re-filed” online. It will be 3 years this July, what is the city’s incentive to push this through? They are really dragging their feet on a simple app. Any one else have similar troubles? Any insight?

  1. I googled Moseson and 421(a) tax abatements and came across this discussion. It seems like we aren’t the only condo board having issues with Moseson. Moseson did our initial filing for our condo and there were some errors that require refiling and now he wants to charge us 10K to fix those errors. It all seems very fishy to me. If people have similar experiences I would like to discuss them.

  2. That’s true. You have to file with DOF for a refund, once the exemption is in place. Never gone through the process myself for 421-a, but in theory it’s supposed to be straightforward.

  3. thanks wellheythere…AJ was the guy I’ve spoken to when I was looking to replace Moseson. He did seem pretty sharp. I’m thinking if our application drags on for many more months maybe the folks who didnt want to pay may start changing their minds.

    NYGuy7, if you’re asking about my application it is for a new construction condo.

    Another question–my closing lawyer told me you can recover taxes you’ve already paid that would have been covered by the abatement once the abatement goes into effect–is that the way it works? What’s the process?

  4. wellheythere–you’re confirming what I’ve been fearing…we looked into using a different firm but we the apartment owners would have to pay in that case and some of the other owners werent comfortable with that. Is there anyone you actually think does a good job with these things?

  5. It is inexcusable, but like I said not atypical. While it should be a rubber stamp thing, HPD insists on performing quite a massive amount of work to approve an application proportional to what should be required to verify its eligibility. Staffing is a problem there, people rarely stick around long enough to learn how to conform to the byzantine regulations, and as a result a massive backlog has built up over the years. Your only real recourse is to ask your councilmember or public advocate to intervene on your behalf. After 3 years, they should be able to shame HPD into forcing the issue.

    I haven’t heard of HFC, so can’t advise whether they are scumbags or not (odds are against them).

  6. HFC Consulting. Problem is that only they can act on the application and original general contractor, I as homeowner have no standing essentially.

    I have called, left messages and even received return calls. The only info I get is that the APP IS PENDING. Nothing more nothing less. This should be a rubber stamp thing, even if one person is doing it, three years is inexcusable.

    Has anyone had problem and done something to speed up process?
