last year I went through a very expensive nightmare of getting an existing roof deck legalized. I want to add a privacy fence to block out my a**hole neighbors who call and report everything I do.

contractors have told me I don’t need a building permit for a fence, but I’m nervous about gettig slapped with another fine. does anyone know if this would require permits?

  1. A fence depends how high and where you want it. if it is in a residential neighborhood then you can usually go up to 6 feet without a permit.

    Following is a section excerpt of the 2008 construction code:

    SECTION BC 3111: FENCES

    3111.1 Permitted heights. Fences are permitted to be erected to a maximum height of 10 feet (3048 mm) above the ground.

    Exceptions:

    1. In residence districts, as established by the New York City Zoning Resolution, fences are permitted to be erected to a maximum height of 6 feet (1829 mm) above the ground.

    2. Fences in residence districts used in conjunction with non-residence buildings and public playgrounds, excluding buildings accessory to dwellings, are permitted to be erected to a maximum height of 15 feet (4572 mm) above the
    ground.

    3. Higher fences may be permitted by the commissioner where required for the enclosure of public playgrounds, school yards, parks, and similar public facilities.

    Keep this section handy if an inspector walks by but make sure not to cheat.
