I need a bit of help solving a rent problem. I live in a large building, managed by a management company. Every month I get an invoice for my rent. Since I moved in the invoices have been $400 less than what is stated on my lease. Every month I paid the amount stated on the invoice.

Well, today someone from the accounting dept gave me a call- apparently after 4 months they actually did some accounting a found the mistake. Now they want to pay an extra $1200 (4 months of incorrect invoices). Part of me wants to say a big F*ck You to them, since it was their error but of course there is that stubborn lease. Do I have an argument? And please no lectures! I came here for advice.

  1. Entertaining post. Although I laud 7 & 5 for withstanding the withering criticism, I agree the ethics are questionable.

    However, having been not treated well by management companies and slumlords before, my sympathies to the landlord only go so far and I can imagine wanting to screw them as I have been screwed by them before. 7 & 5 used leverage successfully, as is done constantly in business, and everywhere else. Not admirable, not what I would have done, but not criminal. And absolutely commonplace. The admonitions here rang a bit false.

    Made me wonder how many that posted may have upon occasion been too liberal in taking tax deductions or not reported all income. Is “stealing” from the government so much different than stealing from a property management property, where the owners may hide in the anonymity?

    And what if your utility company undercharged you over, say, two years, you suspected it at the time but did not report it? Should you be expected to hold onto the delta into the billing is corrected and you get an invoice for perhaps several thousand dollars? I suspect most would resist or at least resent have to fork up the money the utility now wants. When is trying to avoid coughing up the money ethical and when not?

  3. As others have said its the illusory sublet provisions of the rent stabilization law. Actually I gave them the contact details of Steven De Castro, the well known tenant lawyer – he represented some of the regulated tenants in the Ekonomakis case – anyone representing themselves in Housing Court is asking for trouble.

  4. I am absolutely shocked! You ripped them off. They obviously gave you the $700 because it would have cost them more to take you to court.
    But that money you got is stolen.
