Hi,
We are buying a 3 family 4 storey house (cellar, basement, first, second, third floors) house and intend to convert it to a 2 family. We would like to use the triplex and front room of the garden level for ourselves and rent out a studio in the back of the garden/basement level.
Can anyone advise if we have to actually configure the front room to give exclusive and designated access from the parlor floor? Or is it possible to just use the common stairway, lock the door and say its a shared space with the studio apt?

  1. There can be landlord-tenant and other consequences to use of a building that does not conform to its CO. Brooklynexpediter referred to one. Another issue is whether an apartment already existed in the location where you’re thinking of creating the studio. Lots of factors, including whether you’re talking about “use” or, as you also wrote, “convert” (and change your tax class?).

  2. If it will be a shared space that may consider it as a single unit and will implicate you having another kitchen. The entrance can be designated any way you want it is it will get exempted from all MDL regulations automatically
