We have a big problem with a bar that opened next to our house. It has been a bit better lately and a big relief during winter time. But now the owner put a tent in the backyard and blasting music. They have live music bands and Dj’s and they leave doors open from the bar to the tent. We hear the music in our house even when all windows are closed and TV or music is on. My question: Is it allowed to have a tent in your back yard as a commercial place? i was trying to look it up but didn’t find anything.

    My neighbors and I are facing a situation of a bar/backyard garden opening on our purely residential block. We have all contacted our neighborhood assoc., the Community Board (meeting to discuss their liquor license is scheduled for next month), our local Councilman, Assembly Woman, Senator, Borough President and the SLA. It is interesting that as far as I can see there is no bill, statute, or law to protect people from being forced to live next to any business that operates in the evenings and has the ability to play music or have live bands. If there is, I have yet to find it.

    It is one thing to move into a space in a commercial district (as in Smith Street) and have the clear understanding that you live next to a bar or lounge. It is quite another to have one move in where there was none for over a decade.

    I will be writing more about this situation as the story unfolds.

    the bar owner is not soundproofing his place and never keep people in at 10 pm.
    i am not waiting for the summer….

    Yes the problem with the bar has been going for 2 years!
    The tent is a new issue.
    Everytime we feel we are actually about to solve the problem, the owner comes with something new.
    For a whole year we were trying to solve it with the bar owner.
    The big problem is that he IS NICE ! Also to the police and that is how he fulls everybody around.
    We talk to him, he says he is sorry and that he will take care of the problem and the next day he is back on blasting music.

  5. No, I don’t live in the same building, and no I am not there all hours of the day and night. This forum is quick to bash people at times without being fair to both sides. Obviously a problem exists, and nearby residents are frustrated with the issue.

    You are probably one of the employees that live at the same building.
    Therefore you spend most of the hours in the bar and go to sleep when the bar is CLOSED and during the morning.
    We will be curious to see how you will cope if you couldn’t have a sleep after work.
    The bar owner owns the building. There is NO WAY someone is coping with that noise upstairs unless he is an employee or pays close to nothing on rent.

  7. Music would not be heard inside our houses unless people were opening and closing the doors to the tent All night!
    We called the bar 4 times before calling the police- no one answer!
    Maybe you were there but we definitely know that doors were open and closed at 3:30 am since this is the last time we called the police. We have truck of everything including sound levels on sat. So please don’t full yourself and others around.

    Here are the facts:
    1. The doors are not always closed when shows and dj’s are playing. People also are going in and out from the bar to the yard/now tent and since the bands and dj’s are in the back and the door is just next to them , the music is very very loud.

    2. Bar that has shows and dj’s has to have acoustic solution. This bar has no soundproofing. It has a glass door and exposed brick which transfer sound very easily. So we hear the music/bass even when the doors ARE closed.
    The bar owner promised to move speakers to the front but obviously he moved it back to the back. One of his employee even told us that when we called in the past to complain that music was very loud. (The doors were CLOSED)

    3. people in the back yard/now tent are NEVER in at 10 PM. there are signs outside that ask people to be nice and respect the neighbors but whenever we ask about the 10 PM agreement the bar owner sends us away. People are very loud outside. sometimes cursing and drunk and the bar owner does nothing regarding that.

    4.It has been going for 2 years already.

    5. the neighbors are very laid back and willing to work with the bar owner. But after 2 years you definitely get upset.

    6. If the bar owner want to work with the neighbors he should imply rules that he keeps.
    Check other bars in the neighborhood and see for yourself how well they imply rules.
    when doors are closed, they are closed! when speakers are moved to the front they should stay in the front!

    people just had enough with those lies and it is very sad it just couldn’t be resolved in a nice way. It is not enough to be nice.
    but now we are a bunch of families so we have more power.

  8. In either case, iheartclintonhill, you are not there constantly, all hours of the day and night, every night to have a grasp of the total problem.

    If you are, then you have a completely different problem and are probbaly incoherent yourself after the first couple of hours!!!
